1. Who we are
These terms and conditions govern the use of the websites published and operated by Simon Lacroix, a sole proprietorship registered with the Quebec enterprise registrar under NEQ 2274467762 and doing business as “Bonjour la toile” (“we”, “us”, “our” or “the publisher”).

2. Scope and acceptance
These terms apply to all websites we publish, listed in the site directory, and to any purchase or subscription made on those sites. Where a site publishes specific terms, they supplement these terms and prevail in case of conflict.
By visiting one of our sites, creating an account, subscribing or placing an order, you acknowledge that you have read these terms and agree to comply with them. If you do not agree, please do not use our sites.
You represent that you are at least 14 years old, or have the consent of the holder of parental authority, and that you have the legal capacity to enter into a contract.
3. Access to our sites and accounts
Access to the editorial content and free tools of our sites requires neither an account nor payment. We strive to keep them continuously available, without being able to guarantee it: an interruption may occur for maintenance, a technical failure or an event beyond our control.
Some services require an account, for example the customer area of bonjourlatoile.com or the administration of a waiting list on mailbonjour.com. You are responsible for the accuracy of the information you provide and for the confidentiality of your credentials. Notify us without delay of any unauthorized use of your account. You may close your account at any time from the account itself or by writing to us.
4. Intellectual property
Unless otherwise stated, all elements of our sites (texts, listings, comparisons, illustrations, visual identities, logos, databases, source code and interfaces) are our property or licensed to us, and are protected by the Canadian Copyright Act and applicable international treaties.
You may view, download and print this content for strictly personal, non-commercial use. Any reproduction, distribution, adaptation, resale or other use requires our prior written permission.
Names composed by our generators and ideas produced by our tools are not reserved by us in any way: you are free to use them. We do not guarantee that a name is available as a trademark, a business name or a domain name, and we perform no trademark search.
Third-party trademarks, names and logos appearing on our sites remain the property of their respective owners. Their presence in a directory or a comparison implies neither a partnership nor an endorsement on their part.
5. Editorial content and tools
Our content is produced for general information purposes. We write it with care, partly with the help of artificial intelligence tools reviewed before publication, and we update it periodically. We do not guarantee that it is complete, accurate at all times, or suited to your particular situation.
Information in our directories (prices, features, availability of a service) comes from the listed companies or from public sources, as of the date it was collected. It may have changed since. Check it with the company concerned before committing.
No content published on our sites constitutes professional advice (including legal, medical, tax or financial advice). Consult a qualified person before making any decision based on this information.
6. Advertising and affiliate links
Our sites are funded in part by advertising and by affiliate programs. Some outbound links are affiliate links: if you make a purchase or sign up after clicking one of them, we may receive a commission from the merchant. This commission costs you nothing extra and does not affect the price you pay.
This commercial relationship does not change our editorial criteria: a listing's position in a directory cannot be bought.
Advertisements are served by a third-party network. We are not responsible for the content of these advertisements or for the sites they link to. The processing of data for advertising purposes is described in our privacy policy.
7. Digital products and services
Depending on the site, we may offer:
- digital products: downloadable files, such as reading journals in PDF, or content produced on demand, such as a report written from your answers;
- online services, free or by subscription: modules to add to your own site, waiting lists, tools.
We sell no physical products and we ship nothing. Descriptions and previews are presented as accurately as possible; a free excerpt is offered whenever the nature of the product allows it, so that you can judge before buying.
We reserve the right to modify, suspend or withdraw a product or service at any time. A withdrawal does not affect files you have already downloaded or subscription periods already paid, which are honoured or refunded pro rata.
8. Prices, taxes and currency
Unless otherwise stated before payment, all prices are in Canadian dollars (CAD). Some products are offered at a price of your choosing, “pay what you want”, with a minimum stated on the page.
Prices are shown before taxes. The Goods and Services Tax (GST) and the Quebec Sales Tax (QST), or any other tax applicable according to your place of residence, are calculated and added at checkout where we are required to collect them.
In the event of an obvious pricing error, we reserve the right to cancel the order concerned and refund you in full.
9. Orders and payment
The sale is concluded when we send you a confirmation by email or when access to the product is opened to you. This confirmation summarizes the product or service purchased, the total price and, where applicable, the subscription period.
Payments are processed by a specialized provider, Stripe, under its own terms. We neither collect nor store your card numbers on our servers. The descriptor on your bank statement is the provider's, shown before payment.
We may refuse or cancel an order in the event of a declined payment authorization, suspected fraud or a pricing error. In that case you will be informed and any amount already charged will be returned to you.
10. Delivery of digital products
Access or the download link is sent by email or displayed on screen immediately after payment confirmation, and at the latest within 24 hours. Content produced on demand is delivered within the time stated on its page. If you receive nothing, check your junk mail folder, then write to us stating the site and the email address used at payment.
Download links may be limited in time or in number of accesses. Keep a copy of the file you receive.
11. Subscriptions
A subscription renews automatically at the end of each period, at the rate then in effect, until you end it. The period, the price and the renewal terms are shown before you subscribe. Any price change is announced to you by email at least thirty (30) days before it applies.
You may cancel at any time from your account or by writing to us. Cancellation takes effect at the end of the period already paid, during which the service remains accessible. A free tier, where one exists, continues indefinitely under the conditions displayed, for example the display of a mention of our brand.
12. Cancellation and refunds
Cancellation and refund conditions are set out in a separate document that forms an integral part of these terms: refund and cancellation policy.
13. Legal warranties
If you are a consumer within the meaning of Quebec's Consumer Protection Act, you benefit from the legal warranties provided by that Act, including the warranty that the product or service conforms to its description and is fit for its intended purpose.
Nothing in these terms excludes, limits or reduces these legal warranties, which apply in addition to any conventional warranty we may offer.
14. Content you entrust to us
Some services let you publish content or pass it through our systems: answers to a form, messages, the listings of a site, the texts of a waiting list. You remain its owner. You grant us the licence needed to host it, display it and transmit it for the purposes of the service, and nothing more.
You warrant that this content infringes no third-party right and no law. We may remove without notice content that is manifestly unlawful, misleading or harmful, and we respond to copyright takedown requests sent to info@bonjourlatoile.net.
When you add one of our modules to your site, you remain responsible for that site, its visitors and the information your form asks of them. We then act as a service provider on your behalf.
15. Acceptable use
When using our sites, you agree not to:
- breach any applicable law or the rights of a third party;
- extract our content in bulk, including by automated scraping, or attempt to reconstruct our databases;
- call our tools or programming interfaces at a rate that degrades their operation for others;
- disrupt the operation of our sites, circumvent their security measures or access them without authorization;
- transmit malicious code, spam or content that is unlawful, defamatory, hateful or misleading;
- impersonate a person or an organization, or resell access to reserved content or services.
We may suspend or terminate your access without notice if you breach these rules.
16. Links to third-party sites
Our sites link to resources operated by third parties, which is the very purpose of our directories. These links are provided for convenience: we have no control over those sites, their content, their business practices or their handling of personal information, and we accept no responsibility for them. Please consult their own terms.
17. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages (including loss of profits, customers, data or business opportunities) arising from the use of or inability to use our sites, or from the use of a name, an idea or information published there.
Our total liability relating to a purchase or a subscription is limited to the amount you actually paid during the twelve (12) months preceding the event giving rise to the claim.
These limitations do not apply in the event of gross or intentional fault, nor to the extent that they would be prohibited by the Consumer Protection Act or any other provision of public order.
18. Personal information
The processing of your personal information is described in our privacy policy, written in accordance with Quebec's Act respecting the protection of personal information in the private sector and the Personal Information Protection and Electronic Documents Act (PIPEDA).
19. Changes to these terms
We may change these terms at any time. The version applicable to your order is the one in effect when you place it; for a subscription, the new version applies from the next renewal, after being announced to you. The effective date appears at the top of this document.
20. Governing law and jurisdiction
These terms are governed by the laws in force in the Province of Quebec and the federal laws of Canada applicable therein.
Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of the judicial district of Laval, Province of Quebec. If you are a consumer, this clause does not deprive you of the right to bring proceedings before the court of your place of residence where the law allows it.
21. Language
In accordance with the Charter of the French Language, the French version of these terms is the official one. This English translation is provided for convenience; in the event of any discrepancy, the French version prevails. Some of our sites are published in English or in other languages; these terms apply to them in the same way.
